2. Authorization for Services
"By scheduling an appointment for services or repairs through this website, phone, or any other method, you, the customer, authorize Auto Aid Mobile Mechanic Inc. to perform the requested work on your vehicle."
3. Recording of Services
"Auto Aid Mobile Mechanic Inc. reserves the right to audio and video record services and repairs rendered to your vehicle for quality assurance and dispute resolution."
4. Communication Requirements
"If you, the customer, are unable to communicate effectively in English, you must provide a translator to ensure that the services agreed upon and rendered are fully understood and approved in advance. Auto Aid Mobile Mechanic Inc. reserves the right to refuse any request for services, repairs, estimates, or appointment bookings if, in our sole discretion, we determine that effective communication with you is not possible."
5. Vehicle Eligibility
"Auto Aid Mobile Mechanic Inc. only provides services and repairs for cars that are insured and roadworthy. We do not provide services to move parts from one vehicle to another vehicle to test their capability or viability. Roadworthy is defined as being 'legally operable on public roads.'"
6. Liability for Illegal Modifications
"Auto Aid Mobile Mechanic Inc. shall not be liable for any services or repairs performed on your vehicle if it contains any modification violating provincial/federal regulations, whether such modifications were made prior to or following the services provided by Auto Aid Mobile Mechanic Inc. (This includes, but is not limited to: removal of catalytic converter, removal and/or modification of the EGR (Exhaust Gas Recirculation) system, etc.)"
7. Third-Party Warranty Disclaimer
"Auto Aid Mobile Mechanic Inc. shall not be liable for any voidance, nullification, or cancellation of a manufacturer’s or third-party warranty resulting from services or repairs performed on your vehicle. It is the sole responsibility of you, the customer, to understand and comply with the terms and conditions of any warranties applicable to your vehicle, and Auto Aid Mobile Mechanic Inc. assumes no obligation or liability in connection therewith."
8. Our Warranty
"Any warranty provided by Auto Aid Mobile Mechanic Inc. is exclusive to the services and repairs performed by us and is neither connected to nor dependent upon any existing warranties from manufacturers, dealerships, or other service providers. Our warranty does not extend, modify, or affect any such third-party warranties, and we bear no responsibility for their terms or conditions."
9. Payment Terms and Non-Payment
"Payment for services and repairs provided by Auto Aid Mobile Mechanic Inc. is due in full upon completion of the work, unless otherwise agreed in writing. By authorizing services, you, the customer, agree to pay the invoiced amount via debit card, credit card, or electronic payable invoice. Failure to remit payment promptly may result in additional fees, including but not limited to a late payment charge of 2% per month (24% annually) and collection costs. In the event of non-payment, Auto Aid Mobile Mechanic Inc. reserves the right to pursue all available legal remedies, including small claims court action in the Regional Municipality of Niagara, under the laws of the Province of Ontario, Canada. If you initiate a chargeback or dispute a credit card payment for services rendered, you agree that your signed authorization for the work, along with any supporting documentation (e.g., invoice, service record), constitutes a binding agreement enforceable in court. You remain liable for the full amount owed, plus any associated legal or administrative fees incurred by Auto Aid Mobile Mechanic Inc. in resolving the dispute."
10. Right to Refuse Service
"Auto Aid Mobile Mechanic Inc. reserves the right to refuse service at our discretion, including but not limited to situations involving unsafe working conditions, illegal requests, or failure to comply with these terms."
11. Scope of Work and Additional Services
"The services and repairs provided by Auto Aid Mobile Mechanic Inc. are limited to the specific work requested and authorized by you, the customer, at the time of booking or as confirmed in writing (e.g., via work order or estimate). Any additional services, repairs, or parts beyond the agreed-upon scope will only be performed with your explicit prior approval and may incur additional charges. Auto Aid Mobile Mechanic Inc. is not obligated to provide extra work or materials beyond the authorized scope, and any claims of misunderstanding or expectation of unapproved services do not entitle you to free or discounted work. You, the customer, are responsible for clearly communicating your service requests, and we reserve the right to refuse additional work not previously agreed upon."
12. Parts and Materials
"Auto Aid Mobile Mechanic Inc. uses parts sourced by us unless otherwise agreed. We are not liable for the performance or failure of customer-supplied parts, and our warranty does not apply to such parts."
13. Warranty Details
"Auto Aid Mobile Mechanic Inc. provides a limited warranty on services and parts for 90 days or 5,000 kilometres, covering defects in workmanship or materials sourced by us. Warranty claims require proof of service and must be reported within the warranty period. This warranty does not cover misuse, accidents, or subsequent modifications."
14. Liability for Customer Property
"Auto Aid Mobile Mechanic Inc. is not responsible for personal belongings left in your vehicle or for pre-existing damage not related to the services performed."
15. Work Location Conditions
"You, the customer, must provide a safe, accessible, and suitable location for services to be performed. Auto Aid Mobile Mechanic Inc. reserves the right to refuse or reschedule service if the location is deemed unsafe or inadequate."
16. Dispute Resolution
"Any disputes arising from services provided by Auto Aid Mobile Mechanic Inc. shall first be subject to good-faith negotiation between you, the customer, and Auto Aid Mobile Mechanic Inc. for a period of no less than thirty (30) days. Should the dispute remain unresolved after this period, it shall be subject to the laws of the Province of Ontario, Canada, with exclusive jurisdiction and venue in the courts of the Regional Municipality of Niagara."
17. Force Majeure
"Auto Aid Mobile Mechanic Inc. is not liable for delays or failure to perform services due to events beyond our control, including but not limited to weather, natural disasters, scheduling conflicts or parts shortages."
18. False Damage Claims
"Auto Aid Mobile Mechanic Inc. shall not be liable for any claims of damage to your vehicle that are not directly attributable to the services or repairs performed by us. Prior to commencing work, we may document the condition of your vehicle (e.g., via photographs, video, or written notes) to establish its pre-service state. Any allegations of additional damage caused by our services must be supported by clear evidence and reported to us within 24 hours of service completion. You, the customer, acknowledge that false or unsubstantiated claims of damage do not entitle you to free services, refunds, or compensation, and Auto Aid Mobile Mechanic Inc. reserves the right to pursue legal remedies, including recovery of costs, if such claims are determined to be fraudulent or made in bad faith."
19. Identity Fraud
"You, the customer, represent and warrant that all information provided to Auto Aid Mobile Mechanic Inc. when scheduling an appointment, requesting an estimate, or authorizing services—including your name, contact details, and payment information—is accurate and belongs to you or an entity you are legally authorized to represent. Auto Aid Mobile Mechanic Inc. reserves the right to verify your identity and may refuse or cancel service if we suspect fraudulent or misrepresented information, at our sole discretion. In the event of non-payment due to identity fraud, you remain liable for all charges incurred, and we reserve the right to pursue all available legal remedies, including reporting the matter to law enforcement and seeking recovery of costs, under the laws of the Province of Ontario, Canada. Any services provided based on false identity do not relieve you of payment obligations."
20. Fraudulent Insurance Claims
"Auto Aid Mobile Mechanic Inc. will not participate in or facilitate any fraudulent insurance claims, including but not limited to inflating repair costs, misrepresenting services performed, or falsifying documentation at your request. All invoices and service records provided by us will accurately reflect the work completed and costs incurred. You, the customer, agree not to solicit or pressure Auto Aid Mobile Mechanic Inc. to engage in such activities. Any attempt to involve us in fraudulent insurance claims will result in immediate termination of service, and we reserve the right to refuse further business with you, report the matter to relevant authorities, and pursue legal remedies for any resulting damages or costs, under the laws of the Province of Ontario, Canada."
21. Fake Emergency Calls
"Auto Aid Mobile Mechanic Inc. reserves the right to verify the legitimacy of any service request, including emergency calls, prior to dispatching to your location. You, the customer, agree to provide accurate details about your identity, vehicle, and location when requesting service. If we suspect a call is fraudulent, misleading, or poses a safety risk—such as directing us to an isolated or unsafe area under false pretences—we may refuse service at our sole discretion, without liability for delays or non-attendance. Auto Aid Mobile Mechanic Inc. is not obligated to respond to requests we deem suspicious, and we reserve the right to report such incidents to law enforcement. Any costs or damages resulting from fraudulent calls, including but not limited to travel expenses or harm, remain your responsibility if found to be intentional."
22. Theft of Tools and Equipment
"Auto Aid Mobile Mechanic Inc. retains ownership of all tools, equipment, and parts brought to your service location until installed or otherwise transferred as part of the agreed-upon services. You, the customer, are responsible for ensuring that the work location does not facilitate theft or unauthorized access to our property during the service period. Auto Aid Mobile Mechanic Inc. is not liable for delays or incomplete work resulting from theft of our tools, equipment, or parts by you or third parties at your site. If theft occurs, we reserve the right to terminate service immediately, charge you for the replacement cost of stolen items if attributable to your negligence or intent, and pursue all available legal remedies, including reporting the incident to law enforcement and seeking recovery under the laws of the Province of Ontario, Canada."
23. Fake Payment Methods
"Payment for services and repairs provided by Auto Aid Mobile Mechanic Inc. must be made using valid, lawful, and authorized methods, including debit card, credit card, or electronic payable invoice, as agreed upon at the time of service. You, the customer, represent and warrant that any payment method you provide—whether cash, check, credit card, or electronic transfer—is genuine, belongs to you or an entity you are legally authorized to use, and is not counterfeit, stolen, or otherwise fraudulent. Auto Aid Mobile Mechanic Inc. reserves the right to verify payment methods prior to accepting them and may refuse service or demand alternative payment if we suspect fraud, at our sole discretion. In the event of payment with a fraudulent method (e.g., counterfeit cash, dishonoured checks, or stolen credit cards), you remain fully liable for the invoiced amount, plus any additional costs incurred by us, such as bank fees, legal fees, or collection expenses. By authorizing services, you agree that your signed acknowledgment of these terms and the service invoice constitutes a binding agreement, enforceable in the courts of the Regional Municipality of Niagara under the laws of the Province of Ontario, Canada. We reserve the right to report fraudulent payment attempts to law enforcement and pursue all available legal remedies."
24. Lien Rights for Unpaid Services
In accordance with the Repair and Storage Liens Act of Ontario, Auto Aid Mobile Mechanic Inc. reserves the right to retain possession of your vehicle as a possessory lien if payment for services and repairs, including any applicable late fees or additional costs, remains unpaid in full. You, the customer, authorize us to hold your vehicle at a secure location of our choosing until all outstanding amounts are settled. If payment is not received within 30 days of written notice of the lien, we may take further action as permitted by law, including but not limited to applying to sell the vehicle to recover the debt, subject to the procedures outlined in the Repair and Storage Liens Act. You remain responsible for all costs associated with the lien, including storage fees, legal expenses, and any shortfall if the sale proceeds do not cover the full amount owed. By authorizing services, you acknowledge and consent to this lien right as part of these terms and conditions."
